General Conditions of Sale

Art. 1 - General Provisions

  1. By browsing this area, the user accesses Vitastrong.it, accessible via the URL: www.vitastrong.it. Navigating and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site itself.
  2. These General Conditions of Sale apply to the sale of products exclusively with reference to purchases made on the site in accordance with the legal provisions by Globax Nutrition SRL Registered Office: Via IV Giugno 81, Serravalle, 47899, San Marino.
  3. The user is required, before accessing the products provided by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
  4. It is possible to use the site and therefore access the products provided by it and purchase them in the following languages:
    • Italian
    • English
    • Spanish
    • French
    • German

Art. 2 - Object

  1. These General Conditions of Sale govern the offer, transmission, and acceptance of purchase orders for products on the Vitastrong.it site.

Art. 3 - Conclusion of the Contract

  1. To conclude the purchase contract, it will be necessary to fill out the form in electronic format and transmit it following the relevant instructions.
  2. It contains a reference to the General Conditions of Sale, the relevant price, the payment methods that can be used, the methods of delivery of the purchased products.
  3. Before concluding the contract, it will be required to confirm the reading of the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
  4. The contract is concluded when the seller receives the form filled out by the user, after verifying the correctness of the data contained therein.
  5. The buyer will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will be done by clicking the "Confirm Order" button at the end of the guided procedure.
  6. Once the contract is concluded, the seller takes charge of the order for its fulfillment.

Art. 4 - Registered Users

  1. When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.
  2. The confirmation will in any case exempt Globax Nutrition SRL, owner of the Vitastrong.it domain, from any responsibility regarding the data provided by the user. The user undertakes to promptly inform Globax Nutrition SRL of any changes to their data at any time communicated.
  3. Should the user provide incorrect or incomplete data or in the event of a dispute by the interested parties about the payments made, Globax Nutrition SRL, owner of the Vitastrong.it domain, will have the right not to activate or suspend the service until the related deficiencies are remedied.
  4. Upon the first request for activation of a profile by the user, Globax Nutrition SRL, owner of the Vitastrong.it domain, will assign the user a username and password. The latter acknowledges that these identifiers constitute the validation system for user access to the Services and the only system suitable for identifying the user and that the actions carried out through such access will be attributed to them and will have binding effect towards them.
  5. The user undertakes to keep their access data secret and to guard them with due care and diligence and not to temporarily transfer them to third parties.

Art. 5 - Product Availability

  1. Product availability refers to the actual availability at the time the buyer places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of several users on the site, the products could be sold to other customers before the order is confirmed.
  2. Even after sending the order confirmation, cases of partial or total unavailability of the goods may occur. In this eventuality, the order will be automatically rectified by deleting the unavailable product, and the buyer will be immediately informed via email or, alternatively, by telephone at the number indicated by the buyer at the time of the order.

Art. 6 - Products Offered

  1. Globax Nutrition SRL, owner of the Vitastrong.it domain, markets:
    • Dietary supplements for sports use, protein foods, and sports clothing and accessories.

Art. 7 - Payment Methods and Prices

  1. The price of the products will be as indicated on the site.
  2. In case of an error related to the methods of order fulfillment due to the responsibility of Globax Nutrition SRL, owner of the Vitastrong.it domain, the same company will notify the buyer promptly.
  3. The prices on the site include VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which order confirmation has already been sent.
  4. Once the desired products are selected, they will be added to the cart. It will be sufficient to follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details can be modified before payment.
  5. Payment can be made via:
    • Credit card
    • Paypal
    • Cash on delivery
    • Scalapay
    • Bank transfer (coordinates indicated in the online purchase procedure)
    • If you buy with Scalapay, you will receive your order immediately and pay in the number of installments chosen. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., to related parties, and their assignees, and authorize such assignment.

Art. 8 - Delivery

  1. Globax Nutrition SRL, owner of the Vitastrong.it domain, ships throughout the Italian territory and the entire territory of the European Union and the Republic of San Marino.
  2. Globax Nutrition SRL, owner of the Vitastrong.it domain, will deliver either to the address provided by the user or to the collection points indicated at the time of purchase.
  3. Delivery is made, for the Italian territory, approximately within 1-2 working days, or, if no delivery date is specified, within the estimated time at the time of selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation.
  4. For the countries of the European Union, delivery will be made approximately within 3-7 working days and, in any case, within a maximum of thirty days.
  5. If delivery is not possible, the order will be sent to the depot. In this case, a notice will specify the location of the order and how to arrange a new delivery.
  6. If it is not possible to be present at the delivery location at the agreed time, please contact us again by email or phone to arrange a new delivery date.
  7. If delivery is not possible for reasons not attributable to us after thirty days from the date the order is available for delivery, we will assume it is intended as a cause for contract termination.
  8. Following the termination, the amounts will be refunded, including delivery costs excluding any additional costs resulting from the choice of a different delivery method than the ordinary method offered without undue delay and, in any case, within 30 days from the date of contract termination. The transport resulting from the termination of the contract may have additional costs that will be borne by the buyer.
  9. Shipping costs are borne by the buyer and are explicitly highlighted at the time of order placement.

Art. 9 - Transfer of Risk

  1. The risks related to the products will be borne by the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them, including shipping costs, is received or at the time of delivery if this occurs later.

Art. 10 - Warranty and Commercial Compliance

  1. The seller is liable for any defect in the products offered on the site, including the non-conformity of the items to the products ordered, as provided by the applicable law.
  2. In case of non-compliance, the buyer who has concluded the contract will be entitled to restore the conformity of the products without charge, by repair or replacement, or to obtain an appropriate price reduction or contract termination concerning the disputed goods and the consequent return of the price.

Art. 11 - Withdrawal

  1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days pursuant to art. 3 of the Consumer Code and as provided by the European Directive 2011/83/EU on consumer rights, starting from the date of receipt of the products.
  2. The user who intends to exercise the right of withdrawal from the purchase can do so by sending a communication to the following email address: [email protected].
  3. The goods must be returned to: Globax Nutrition SRL. Registered Office: Via IV Giugno 81, Serravalle, 47899, San Marino
  4. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the Company will refund the amount of the products subject to withdrawal within a maximum period of 90 days, excluding any shipping costs.
  5. Globax Nutrition Srl will issue the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment made by bank transfer, and if the buyer wishes to exercise their right of withdrawal, they must provide the necessary bank details: IBAN, SWIFT, and BIC required for the refund.

Art. 12 - Data Processing

  1. Buyer data is processed in accordance with the provisions of the legislation on personal data protection, as specified in the appropriate section containing the information pursuant to art. 13 EU Regulation 2016/679 (https://vitastrong.it/en/content/7-privacy-policy).
